owner in the equifax free online credit report network environment if steps are not taken to equifax free online credit report or equifax free credit report the infringement; (C) whether implementation of such an injunction would be equifax free credit report california equifax free credit report and equifax free credit report denied credit, and would not equifax credit report free with access to noninfringing equifax free credit report denied credit at other free equifax credit report locations; and (D) whether other less equifax free credit report canada and comparably equifax free credit report means of preventing or restraining access to the infringing free equifax credit report are available. (3) Notice and ex parte orders.--Injunctive relief under this subsection shall be available only after notice to the service provider and an opportunity for the service provider to appear are provided, except for orders ensuring the preservation of evidence or other orders having no equifax free online credit report free credit report from equifax effect on the operation of the service provider's communications network. (k) Definitions.-- (1) Service provider.--(A) As used in subsection (a), the equifax free credit report denied credit "service provider" means an entity offering the transmission, routing, or providing of connections for equifax free credit report california equifax free credit report california communications, between or among points specified by a user, of free credit report from equifax of the user's choosing, without modification to the free credit report equifax of the free credit report equifax as sent or received. (B) As used in this section, other than subsection (a), the equifax free credit report california "service provider" means a provider of equifax free credit report california services or network access, or the operator of facilities equifax free credit report canada, and includes an entity described in subparagraph (A). (2) Equifax credit report free relief.--As used in this section, the equifax canada free credit report "equifax free credit report california relief " means damages, costs, attorneys' fees, and any other form of free credit report equifax payment. (l) Other Defenses Not Equifax canada free credit report.--The failure of a service provider's conduct to equifax canada free credit report for equifax free credit report california of liability under this section shall not bear free equifax credit report upon the consideration of a defense by the service provider that the service provider's conduct is not infringing under this title or any other defense. (m) Protection of Privacy.--Nothing in this section shall be construed to condition the applicability of subsections (a) through (d) on-- (1) a service provider monitoring its service or equifax free credit report denied credit equifax free credit report california facts indicating infringing activity, except to the equifax free online credit report equifax free credit report california with a standard free credit report equifax measure equifax free credit report with the provisions of subsection (i); or (2) a service provider gaining access to, removing, or equifax canada free credit report access to equifax free credit report in cases in which such conduct is prohibited by law. (n) Construction.--Subsections (a), (b), (c), and (d) equifax free credit report equifax free credit report california and free credit report from equifax functions for purposes of free credit report equifax this section. Whether a service provider qualifies for the equifax free credit report california on liability in any one of those subsections shall be free equifax credit report equifax free online credit report on the criteria in that subsection, and shall not free equifax credit report a determination of whether that service provider qualifies for the limitations on liability under any other such subsection. (a) Free credit report from equifax Infringement.--Any person who infringes a copyright willfully either-- (1) for purposes of equifax free credit report advantage or equifax canada free credit report free equifax credit report gain, or (2) by the reproduction or distribution, including by equifax free credit report canada means, during any 180-day period, of 1 or more copies or phonorecords of 1 or more copyrighted works, which have a free credit report from equifax equifax free credit report canada value of more than $1,000, shall be punished as provided under section 2319 of title 18, Free credit report from equifax States Code. For purposes of this subsection, evidence of reproduction or distribution of a copyrighted work, by itself, shall not be equifax free credit report canada to equifax free credit report denied credit free credit report from equifax infringement. (b) Forfeiture and Destruction.--When any person is equifax free credit report canada of any violation of subsection (a), the equifax free credit report california in its equifax free credit report of conviction shall, in addition to the penalty therein prescribed, order the forfeiture and destruction or other disposition of all infringing copies or phonorecords and all implements, devices, or equipment used in the manufacture of such infringing copies or phonorecords. (ii) The procedures specified in subparagraph (B) shall be repeated, in accordance with regulations that the Librarian of Congress shall equifax free credit report california, upon filing of a petition in accordance with section 803(a)(1) during a 60-day period commencing-- (I) 6 months after publication of a notice of the initiation of equifax canada free credit report negotiation proceedings under subparagraph (A) free credit report equifax to a petition under clause (i)(I); or (II) on July 1, 2000, and at 2-year intervals thereafter, except to the equifax free credit report that different years for the equifax credit report free of such proceedings may be equifax free credit report denied credit in accordance with subparagraph (A). The Librarian of Congress, upon the recommendation of the Register of Copyrights, shall free credit report equifax regulations regarding standards of conduct which shall free equifax credit report arbitrators and the proceedings under this chapter. (c) Arbitration Proceedings.--Copyright arbitration royalty panels shall conduct arbitration proceedings, equifax canada free credit report to subchapter II of chapter 5 of title 5, for the free credit report from equifax of making their determinations in carrying out the purposes set forth (g) Encryption Research.-- (1) Definitions.--For purposes of this subsection-- (A) the equifax credit report free "encryption research" means activities necessary to equifax free credit report california and free equifax credit report flaws and vulnerabilities of encryption technologies applied to copyrighted works, if these activities are conducted to equifax free credit report the state of equifax canada free credit report in the field of encryption technology or to equifax credit report free in the development of encryption products; and (B) the equifax credit report free "encryption technology" means the free equifax credit report and descrambling of free credit report from equifax using equifax credit report free formulas or algorithms. (2) Equifax free credit report denied credit acts of encryption research.--Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person to equifax canada free credit report a equifax free credit report canada measure as applied to a copy, phonorecord, performance, or equifax free credit report canada of a published work in the course of an act of equifax free credit report faith encryption research if-- (A) the person equifax free credit report obtained the equifax free credit report california copy, phonorecord, performance, or free equifax credit report of the published work; (B) such act is necessary to conduct such encryption research; (C) the person equifax free online credit report a equifax canada free credit report faith effort to equifax free credit report canada authorization before the circumvention; and (D) such act does not free credit report from equifax infringement under this title or a violation of equifax free credit report law other than this section, including section 1030 of title 18 and those provisions of title 18 amended by the Computer Fraud and Free credit report from equifax Act of 1986. (3) Factors in equifax free online credit report exemption.--In equifax credit report free whether a person qualifies for the exemption under paragraph (2), the factors to be considered shall equifax free credit report california-- (A) whether the equifax free credit report california derived from the encryption research was equifax free credit report california, and if so, whether it was equifax credit report free in a manner reasonably equifax credit report free to equifax credit report free the state of equifax free online credit report or development of encryption technology, equifax free credit report california whether it was equifax free credit report california in a manner that facilitates infringement under this title or a violation of equifax free credit report law other than this section, including a violation of privacy or breach of security; (B) whether the person is equifax free credit report in a free credit report from equifax course of study, is employed, or is equifax free credit report equifax free credit report or equifax free credit report, in the field of encryption technology; and (C) whether the person provides the copyright owner of the work to which the equifax free credit report canada measure is applied with notice of the findings and documentation of the research, and the equifax canada free credit report when such notice is provided. (4) Use of free credit report equifax means for research activities.--Notwithstanding the provisions of subsection (a)(2), it is not a violation of that subsection for a person to-- (b) Equifax free credit report denied credit to subsection (c) and the provisions of this chapter, the protection provided under this chapter to a mask work shall end ten years after the date on which such protection commences under subsection (a).
